Vaccination Requirements

On September 9, 2021, President Biden announced the “Path out of the Pandemic” COVID-19 Action Plan – a national strategy with a six-pronged approach aimed at more aggressively combatting effects of the pandemic.

A main point in the plan, which falls under the initial “Vaccinating the Unvaccinated” portion, seeks to drastically increase the number of vaccinated individuals across the country through increasing the number of individuals who fall subject to vaccination requirements. The Department of Labor’s Occupational Safety and Health Administration (OSHA) has been directed to issue a new Emergency Temporary Standard (ETS) which will require all employers with 100 or more workers to mandate that their employees get vaccinated or subject to weekly testing if they choose not to get the vaccine. This ETS will also require employers to provide their workers with paid time off to cover the time it takes for employees to get the vaccine and recover from potential side effects.

It is estimated that more than 80 million workers in the private sector will be affected by this new requirement. Applied Business Solutions will provide our clients with guidance on the legal implications of the COVID-19 Action Plan as we are updated.
